The decision was split after the Arcansan State Supreme Court affirmed the original ruling by Pulaski County Circuit Court Judge Tim Fox that the committee’s approval of CNB’s Pope County casino license was “unconstitutional.” The ruling by the circuit court came after Gulfside Casino Partnership appealed the ARC’s decision to award the Pope County license to CNB’s Legendary Resort and Casino Company.
Judge Cross reportedly said, “After learning of the conclusion of the Arkansas Supreme Court’s split decision on casino litigation affecting Faf County, I issued an updated exclusive support letter to Cherokee Nation Business in the name of Cherokee Nation Entertainment as required by the 100th Amendment, and the technical issues identified by the court have been resolved. This letter was submitted to the Arkansas Horse Racing Commission on Thursday, October 26, 2023, as defined by the statute, and I hope to expedite the application process as defined by the Commission’s rules. I sincerely hope that the Commission will regard this as a means of prompt resolution and conclude what has been a wasteful process for the citizens of Pope County.”
As reported by TBP, the 100th Amendment of 2018 was approved by voters to anticipate that license applicants would need a letter of support from Russellville Mayor Fred Teague and a letter of support from Pope County Quorum Court as an alternative to Pope County Judge Ben Cross for planned locations within city limits.
